Schickerling Property Pty Ltd provides you with this Policy so you will know and understand how we obtain, use, disclose, store, secure and dispose of your personal information.  Schickerling adopts and is bound by the Australian Privacy principles (“APPs”) contained in the Privacy Act 1988 (Cth) (“the Act”).

This Privacy Policy covers Personal Information collected, used and disclosed by Schickerling Property Pty Ltd in relation to:

What is Personal Information?
“Personal information” is information we hold which is identifiable as being about you.  It is information or an opinion that identifies you including name, address/es, email address/es and phone numbers.  If necessary, we may also require the details of your company’s ABN and/or ACN, financial information including bank account details, profit and loss statements, balance sheets, your employer and occupation details and title and mortgage details of any relevant property.  We may need to take photos or video imagery inside your home.

Schickerling Property Pty Ltd may be able to obtain other information about you from Social Media platforms which may not itself constitute Personal Information or which, when combined with other information, can identify you, including photos, videos and any other information that you include on our Social Media Sites or sites linked to our Social Media Sites. The level of information to which we have access may depend on your privacy settings on such other Sites.

How do we collect your Personal information?

Schickerling Property Pty Ltd will, from time to time, receive and store personal information.

We collect this information in several ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you, including but not limited to:

  • by making an enquiry by phone or email
  • by visiting any of our social media sites, including but not limited to Instagram, Facebook, LinkedIn, Pinterest, YouTube etc.

The following information we may collect from time to time, for statistical purposes only (analysis that does not identify you), is:

How do we use your personal information?

Schickerling Property Pty Ltd may use personal information collected from you to provide you with information, updates and to enable us to carry out our services as professional real estate agents and property advisors. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.

Schickerling Property Pty Ltd may contact you by a variety of measures including, but not limited to email, telephone, SMS or post.

In accordance with this Privacy Policy, you consent to your Personal Information being used:

  • by providing Schickerling Property Pty Ltd with your contact details and consent in writing to pass these on to a financier or mortgage broker
  • by formally engaging Schickerling Property Pty Ltd, you consent to us conveying your Personal Information to third party organisations we may engage to provide our complete tailored service to you.

Disclosure of Personal Information

We do not and will not rent, sell or otherwise disclose your Personal Information to any other company or organisation, without your prior consent, where that consent is required by law.

Schickerling Property Pty Ltd may reasonably disclose your personal information to any of our employees, officers, insurers, professional advisors, agents, suppliers or subcontractors necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.  This includes and is not limited to:

  • to the vendor or landlord of a property where you are either a buyer, tenant, prospective buyer or prospective tenant;
  • to other real estate agents or other third parties if required by a landlord or a landlord’s financier or legal representative, for the purpose of appraising or valuing a property;
  • to potential landlords and tenants, to trades people and to other persons to whom we outsource functions of or incidental to acting for a landlord or a tenant;
  • to the general public when advertising or marketing your rental property (or your home if you are our tenant) including internet advertising or marketing, for the purposes of re-leasing or selling the property;
  • to the landlord, referees, the relevant Bond Authority, other agents and third-party operators of tenancy reference databases including where a tenant has failed to comply with any contractual obligations specified in the relevant tenancy agreement and to other sources necessary to identify and evaluate a potential tenant;
  • to potential buyers or to existing or potential clients, to media organisations, including on the internet, to property inspection consultants, property valuers, to government and statutory bodies, financial institutions and service providers.

We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.

We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Schickerling Property Pty Ltd, its customers or third parties.

If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would only disclose information in good faith and where required by any of the above circumstances.

By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

Disclosure of your Personal Information on Social Media

By engaging with any of our Social Media pages, you agree to and are subject to the terms and conditions of the Social Media site. Any Personal Information pinned or posted or uploaded by you onto Social Media can be disclosed in accordance with the terms and conditions and privacy policies of the Social Media site.

Content pinned or posted to Social Media will be made available to the general public to view and may be re-pinned and re-posted by others making it visible to anyone visiting the locations to which the content has been re-pinned. You may be able to remove the content you have pinned or posted from the location at which you pinned or posted it. However, any content that has been re-pinned will be out of our control and neither you nor we will be able to remove it from any re-pinned location. We are not responsible for any content that has been re-pinned or re-posted.

We reserve the right to remove any photos, comments or other material that is in any way inappropriate or offensive (in our opinion) from our Social Media pages.

Security of your personal information

Schickerling Property Pty Ltd is committed to ensuring the information you provide to us is secure.  We pride ourselves on our physical, electronic and managerial procedures we have in place to safeguard and secure your information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

Our website contains links to other websites. We have no control over the privacy practices employed at other websites and we accept no responsibility for Personal Information provided via unsecured websites.

We cannot provide any guarantee with respect to the security of your Personal Information and we will not be liable for any breach of security or unintended loss or disclosure of information due to the website being linked to the Internet.

The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us or receive from us. Whilst we take strong measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

Access to your personal information

You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information, which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at concierge@schickerling.com.au.

We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.  If we deny your request for access, we will let you know why.  If we refuse to amend information we hold about you, we will let you know why.

If your Personal Information is amended, we will take reasonable steps to inform third parties to whom we have disclosed your Personal Information, so that they can amend their records.

We take reasonable steps to permanently destroy Personal Information that is no longer required.  However, where required by law to retain Personal Information in our files, this may be kept for up to seven years.

Complaints about privacy

If you have any complaints about our privacy practices or you believe we have not complied with our obligations pursuant to the Act or have a complaint about the use or disclosure of your Personal Information by us, please feel free to send in details of your complaint to The Officer In Effective Control, PO Box 274, Essendon, VIC, 3040.

We will treat the process, and all details of your complaint, in strict confidence. If we need to discuss any issues arising from your complaint with someone outside of the agency, we will obtain your consent first.

We take complaints very seriously and will respond shortly after receiving written notice of your complaint.  The length of time will depend on the nature and complexity of the issues you have raised.

Changes to our Privacy Policy

Schickerling Property Pty Ltd may amend or update this Privacy Policy at any time at our sole discretion and all changes will be effective immediately upon our posting of the changes on our website.
